Organizations or dealerships granting platform access to employees are responsible for ensuring that those users comply with these Terms and Conditions.
Users may be required to create an account to access certain Services.
Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.
Users agree to immediately notify Motoring Excellence of any unauthorized use of their account or suspected security breach.
Motoring Excellence shall not be liable for losses or damages resulting from unauthorized access caused by user negligence or credential sharing.
All content, materials, training systems, methodologies, software, branding, trademarks, logos, designs, and intellectual property associated with Motoring Excellence are the exclusive property of Motoring Excellence.

No ownership rights are transferred to users through purchase, registration, or access to the Services.
Motoring Excellence grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Services strictly for legitimate professional development purposes.
Users who purchase individual access may use the training for their personal professional development only. The following actions are strictly prohibited:
Where dealership or multi-user licenses are granted, usage is limited strictly to the number of authorized users specified in the license agreement.
Unauthorized access or credential sharing may result in suspension or termination of access.

All fees for Services are payable in advance unless otherwise agreed in writing.
Motoring Excellence reserves the right to suspend or restrict access to Services if payment obligations are not fulfilled.
Prices for Services may be updated at any time; however, price changes will not affect purchases already completed.
All purchases made through Motoring Excellence are final.
Due to the digital nature of the Services and the immediate access granted to proprietary intellectual property, all purchases are non-refundable.
By completing a purchase, users expressly agree that no refunds, cancellations, exchanges, or chargebacks will be provided except where required by applicable law.
Users agree not to initiate payment disputes or chargebacks without first contacting Motoring Excellence to attempt resolution.
If a chargeback is initiated in violation of these Terms, Motoring Excellence reserves the right to immediately suspend platform access and pursue recovery of outstanding fees and associated costs.
Motoring Excellence provides educational and professional training content intended to support automotive sales professionals.
Motoring Excellence does not guarantee specific outcomes including but not limited to:
Results depend on numerous factors including user effort, dealership environment, market conditions, and individual abilities.
To the fullest extent permitted by law, Motoring Excellence shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the Services.

The Services are provided on an "as is" and "as available" basis.
Motoring Excellence expressly disclaims all warranties, express or implied, regarding the reliability, availability, or accuracy of the Services.
To the maximum extent permitted by law, the total liability of Motoring Excellence arising from the Services shall not exceed the total amount paid by the user for the Services within the twelve (12) months preceding the claim.
Motoring Excellence may periodically perform updates, maintenance, upgrades, or improvements to the platform and related services.
During such periods, parts of the platform may become temporarily unavailable.
Motoring Excellence shall not be liable for any losses, damages, or disruptions resulting from maintenance activities, system upgrades, technical failures, or service interruptions.

Motoring Excellence may obtain dealership or automotive business information for marketing or operational purposes from publicly available sources including publicly accessible websites, online directories, and industry listings.
All such information is sourced from publicly available data.
Motoring Excellence does not collect confidential dealership information and does not publicly distribute dealership information through its platform.
Motoring Excellence is committed to protecting user privacy.
Personal information collected through the platform is processed solely for legitimate business purposes including service delivery, communication, account management, and operational functionality.
Motoring Excellence does not sell or distribute personal information of users, clients, or dealerships to unauthorized third parties.
The collection and processing of personal information is governed by the Motoring Excellence Privacy Policy.
Motoring Excellence processes personal information in accordance with the Protection of Personal Information Act (POPIA), Act 4 of 2013.
Appropriate administrative and technical safeguards are implemented to protect personal information against unauthorized access, misuse, loss, or disclosure.
